The filing of a complaint does not necessarily imply the initiation of investigative actions by the Anti-Fraud Office of Catalonia. In certain cases, the Anti-Fraud Office will not initiate any investigative actions.
You can report to the Anti-Fraud Office any acts of corruption that affect the general interests or the management of public funds in the public sector of Catalonia, of which you are aware. You can also report possible infringements of Union Law and/or serious or very serious criminal and administrative infringements of our legal system under the terms of Law 2/2023, of 20 February. Content of the report
Under the terms of article 18 of Law 2/2023, reports must contain, at least::
- A clear, concrete, intelligible, plausible description of events located at a clear chronological moment and in a specific place
- The person(s) (natural or legal) who may be responsible must be identified
- The complaint must include additional supporting information (supporting documentation, reference to complementary information, possible witnesses, additional evidence or offers of evidence, etc.)
Complaints about the following will be inadmissible:
- Overly generic or indeterminate facts, etc.
- Events in which people cannot be identified as possible alleged offenders or without a clear place or time
- Facts based on rumors and statements, on deductions or suspicions, without any objective evidence
- Facts that are not linked to actions or omissions that may constitute infringements of European Union law, or that may not constitute a serious or very serious criminal or administrative offence
- Facts located outside the territorial scope of Catalonia, or the possible irregularity is not circumscribed to the aforementioned territorial scope
- Events already reported to another competent body/organization for processing
- Facts already resolved by this Office without the provision of new relevant data
Malicious, frivolous, abusive or bad faith complaints will also be inadmissible.
