The purpose of these proceedings is to analyze whether there is a cause of incompatibility in the figure of an elected position, as well as whether there is a prohibition to contract with a successful company due to a possible conflict of interest. It is confirmed that, indeed, there is an objective cause of incompatibility in the elected position and that, despite this, the resignation has not been chosen, either in the elected position or in the contractor position. It also turns out that the awarded company is incurring a prohibition to hire, given that it is participated by an elected position of the same council.
