The investigative action begins with a report filed for possible preferential treatment towards a worker who had been appointed to a position of command in the reported entity. However, the Office has agreed to file it, given that the organizational changes that occurred in the Open Administration Consortium of Catalonia in the years between 2013 and 2016, which entailed a restructuring of different jobs, affected not only the person reported, but also other workers in the consortium, and it seems that they were adopted in accordance with what was established in the agreement and with the approval of the Generalitat of Catalonia, the administration to which the consortium is attached. Thus, the issues that may arise with respect to the restructurings analyzed are of mere ordinary legality and, therefore, fall outside the scope of action of the Office.
