The object of the investigation, initiated following a report, is about an alleged favorable treatment by the Generalitat of Catalonia to a private company in the award of a surface right with an option to purchase and a lease connected with the previous operation. According to the results of the examination carried out, certain irregularities have been found in both operations, which, considered as a whole, are compatible with the reported favoritism. In one case, there are unjustified changes in the conditions of the lease contest with respect to a previous call declared deserted, including the restriction of the location area and the typology of the property to be leased, as well as the reduction of the term for the presentation of offers. In the other case, as more relevant issues, it is noted the irregular inclusion of a real right of purchase option, the lack of justification of the amounts of the fee for the surface right and the future sale price and a conflict of interest of a person who would have intervened in this procedure.
