The proceedings were initiated by a report according to which the appointment of the data protection delegate, through a service commission, would have been carried out without the prior creation of the position and without competition, and that the City Council would have assumed the cost of the prior training necessary for the development of the aforementioned job position. Some of the irregularities reported are confirmed; however, given the date on which the service commission and the training on personal data protection reported (in 2019), and the fact that it has been verified that, since 2022, the tasks of the data protection delegate have been outsourced to a private company, prior to the corresponding tender by the simplified open procedure, in application of the principles of effectiveness, efficiency, subsidiarity, proportionality and congruence that must inform the action of the Anti-Fraud Office, the proceedings are filed.
